These are the Terms and Conditions (“Terms”) of Your Movie Ltd, a company registered in England and Wales, with its registered address at 58 Fennel Drive, Red Lodge, IP288UZ, company number 12994722 (“ Your Movie”, “we” or “us ”). Your Movie owns and operates the websitewww.yourmovie.co.uk (the “ Website”).
Throughout these Terms, we refer to other documents which apply to your use of the Website and the Your Movie’s Services, namely the privacy policy and cookie policy (the “Policies”)
Your Movie uses Amazon Web Services (hereinafter referred to as “AWS”) for the upload/download of files on the Website. Please check the AWS’s Terms and Conditions carefully and by clicking “I Agree” on the Website you agree to be bound by AWS’s terms.
If you do not agree to these Terms or the Policies, you must not use the Website or the Your Movie Services.
1. Definitions
The following terms used in these Terms have the following meanings:
a. Account – means an account you create on the Website.
b. Creator – means a person, company or legal entity who offers or provides the Creator Services to Customer.
c. Creator Fee – means a 18% fee deducted from the Movie Fee and retained by Your Movie for enabling the Creator to use the Your Movie Services and the Website.
d. Creator Balance – means an aggregated amount of the Creator Revenue.
e. Creator Revenue – means 80% of the Movie Fee payable to the Creator by Your Movie after completion of the Creator Services.
f. Creator Services – means the services offered or provided by the Creator in relation to the creation of a Movie on behalf of the Customer.
g. Customer – means a person, company or legal entity who buys the Creator Services in line with these Terms.
h. Customer Balance – means the refunded amount of any cancelled orders received by the Customer.
i. Customer Content – means the photos or video footage provided by the Customer to the Creator using via the Website using AWS to enable the Creator to provide the Creator Services.
j. Final Fee – means the Movie Fee and the Service Fee.
k. Movie – means a short video clip offer for creation or created by the Creator using Customer Content.
l. Movie Fee – means the fee for the Creator Services paid by the Customer. Service fee is not included in Movie fee.
m. Public Profile – means the place on the Website for Creators to advertise their Creator Services.
n. Service Fee – means a fee equivalent to 10% of the Movie Fee.
o. Service Package – means the summary of all aspects of the Creator Services and the Final Fee published on the Public Profile.
p. you – means a Customer, a Creator or a visitor of the Website.
q. Your Movie Services – the services provided to Creators and Customers through the Website, subject to these Terms and the Policies.
2. Setting up your account
a. To access the Your Movie Services, you must set up an Account using your email address and by creating a password. We recommend you use “strong” passwords that combine upper and lower case letters and numbers. You must keep your password confidential and not disclose it to any third party. Your Movie has the right to disable an Account if we believe a security breach has happened or we have a reasonable belief that the Account owner has failed to comply with these Terms, or their actions are illegal, immoral or damaging to our reputation.
b. You must be at least 18 years old and be legally allowed to set up an Account in your jurisdiction. You are not allowed to use the Your Movie Services if doing so is prohibited in your country or under any law or regulation applicable to you.
c. You are fully responsible for keeping the personal details and any information on your Account up to date at all times.
3. Your Movie Services
a. Your Movie provides the Website where Creators can advertise their movie creation services and Customers can purchase these services. It is where clients meet creators, where clients share their vision with footage and creators make it come true. Communication between Creators and Customers is through the Your Movie internal communication system, and Customer Content may be transferred between them using via the Website using AWS.
b. Your Movie only provides the Website that enables you to sell/purchase Creator Services, but it does not sell/purchase the movie making services itself.
c. As such, the Creator is solely responsible for ensuring that the Creator Services are provided to a standard reasonable expected of a professional in the movie making industry and in accordance with all applicable laws, using legally obtained movie making software and not in breach of the intellectual property rights and copyrights of any third party (please refer to clause 6 for further information). Further, the Customer shall become the sole owner of the Movie and is fully responsible for the consequences of publishing, sharing or distributing the Movie and any consequences of this.
d. The Creator is solely responsible for ensuring that Customer Content is protected and kept confidential at all times.
e. All information published by the Creator on the Website, including the Public Profile, must comply with these Terms. Your Movie is not responsible or liable to any third party for the information or content of the Public Profile.
f. You undertake to comply with all applicable laws and regulations in connection to the advertising of the Creator Services or the purchase of the Creator Services.
g. Your Movie may from time to time use automatic scanning filters in order to prevent fraud or any activity that is contrary to these Terms and applicable legislation. Your Movie will analyse the automatic scanning filter results and based on them we might hide or give you a notice with request to alter/change any of information we believe breaks these Terms or is against the law.
4. Customer’s Specific Terms
a. After you have chosen the Creator you like and have decided to proceed with the Creator Services, you have to:
i. make a registration on the Website (if you have not done that before);
ii. pay the Final Fee shown at the check-out; and
iii. describe your expectations, ideas and requirements regarding the movie, including any specific requirements, or you can leave this to the Creator to decide. Please closely communicate with the Creator for the best movie creation experience.
b. You then need to send all Customer Content to be included in the movie to the Creator via the Website and by AWS. By doing so, you confirm that you agree to AWS’s terms.
c. You are responsible for ensuring that:
i. you retain full, perpetual and sole ownership of the Customer Content and can dispose, modify, merge or divide the Customer Content at will;
ii. you have consent from any individual where the Customer Content contains personal data of others;
iii. the Customer Content has no pornography, propaganda and any other harmful or unlawful videos/photos or files;
iv. you comply with copyright and intellectual property rights, as explained in clause 6;
v. you only send the Customer Content to the Creator via the Website and by AWS; and
vi. any images, text or information that you upload to the Website, including any reviews that you post about others, comply with these Terms and the Policies.
d. By using the Your Movie Services, you acknowledge that Your Movie is not under any circumstances responsible for your choice of Customer Content nor the transfer of the Customer Content.
e. So that the Creator has all relevant information about your needs and ideas for the Movie, you should complete the specific requirements form, giving as much information as necessary. If you would prefer the Creator to decide all the details of the Movie, you can skip this step. Where clear and specific requirements have been provided to the Creator, it is the Creator’s responsibility to create the Movie in line with these. If the Movie is in line with your requirements, you cannot then reject the Movie if you do not like it.
f. If you have chosen not to give clear, specific requirements to the Creator, and have left the Movie for the Creator to decide, you cannot under any circumstances reject the Movie if you don’t like it. The Creator does not make any warranties about elements that were not discussed and agreed with you and were left to their freedom to decide.
g. If you have an issue with the Movie, please refer to clause 9 on how to deal with the dispute.
h. You understand that a legally binding contract is formed between you and the Creator once the Creator has accepted your order, you have paid the Final Fee and you have received confirmation email. If you change your mind, you cannot receive a refund once the Creator Services have commenced.
i. You may ask the Creator to revise the Movie as many times as it is mentioned on the Service Package. You may not do this if you have accepted the Movie or revisions are not included Service Package.
j. The Creator must use your Customer Content only for providing the Creator Services you have purchased. The Creator must not use your Customer Content for any other purpose whatsoever and is not permitted to share it publicly or with any third parties. If you have reason to believe the Creator has breached this, please let us know and the Your Movie team will investigate the issue.
k. You must not circumvent these Terms by communicating with Creators or agreeing the provision of the Creator Services outside of the Website, whether for payment or not. To do so is a material breach of these Terms. If you have been asked by the Creator to do so, please report it to us by email to reports@yourmovie.co.uk as soon as possible.
5. Creator’s Specific Terms
a. Once you have received an email and message on your Account requesting your Creator Services and you have confirmed this order with the Customer, a legally binding contract is formed between you and the Customer. The Movie creation period should be agreed with the Customer based on your availability and your services delivery time. If you have issues providing the Creator Services on time, you must inform the Customer immediately and provide the Creator Service as soon as possible or as agreed with the Customer.
b. When providing the Creator Service, you acknowledge and agree that the Customer is providing you with a limited, non-exclusive, non-transferable, royalty free licence to use the Customer Content for the sole purpose of creating the Movies for the Customer only. You are not permitted to use Customer Content for any other purpose whatsoever, and this includes that you are not permitted to share the Movie or the Customer Content publicly or with any third party. To do so is a material breach of these Terms.
c. You are responsible for ensuring that:
i. You have the required abilities to provide the Creator Services you advertise on your Public Profile, and you provide the Creator Services with reasonable care and skill and to a standard reasonable expected of a professional in the movie making industry;
ii. you are using legally obtained movie making software or services;
iii. you comply with copyright and intellectual property rights, as explained in clause 6;
iv. any example of movies listed in your Public Profile: (I) belong to you; (II) were created by you; (III) have no tags, company or other identification; and (IV) are respectful, legal and harmless to people of all ages;
v. your behaviour with Customers and the Your Movie team is professional and polite at all times. We may suspend or terminate your Account if we receive any reports that you are unprofessional, impolite or you communicate in a harmful manner, which is considered a material breach of these Terms; and
vi. any images, text or information that you upload to the Website, including any reviews that you post about others will meet these Terms.
d. You accept that Your Movie is not responsible for any content you upload to the Website and it is your responsibility to carefully choose which content you wish to be uploaded on the Website or to the Customer.
e. You must not offer or/and sell your Creator Services on the Website if it is illegal in your country of residency.
f. You must not advertise any illegal videos or movies, which in any way can harm other visitors (such as pornography, propagandas or any other harmful or unlawful videos/photos or files).
g. You will be responsible for being aware of and complying with all applicable law regulating you as a Creator in your country of residence, and Your Movie is in no way responsible for this.
h. The prices of your Creator Services should be shown on Services Packages in your advertisement of your Creator Services. You may add extra services to your Service Package with additional prices.
i. The Services Packages table will be shown in your advertisement of Creator Services. Each Service Package should have:
i. the name of the Creator Services;
ii. the features included in the Service Package;
iii. the Movie Price; and
iv. the delivery time of Creator Services.
j. You have to fill in all information above to form your Service Package table.
k. You are liable for the payments of any and all taxes that apply to you in line with your national law and specific financial regulations.
l. You can remove a listing of Creator Services and/or cancel an order for the provision of Creator Services to a client at any time before you confirm the order with the Customer. Once you confirm the order with the Client, you cannot cancel the order and you are committed to providing the Creator Services as agreed. If you decide to cancel your order without reasonable explanation after having confirmed the order with the Customer and committed to deliver the Creator Services, you may receive a warning from us, and we may temporarily or permanently suspend your Account, depending on how many times you have cancelled your orders. By cancelling orders without reasonable explanation, you make the Customer unsatisfied about your and our services which is likely to damage our reputation.
m. If you decide to cancel an order after confirming it without having a valid reason for cancellation, you will lose the possibility to earn from your Creator Services. All money paid by the Customer will be refunded to the Customer Balance.
n. You may be required to revise the Movie as many times as the Customer requests and you mentioned in the Service Package, if asked by the Customer. If you did not include the number of revisions in your Service Package, you do not have to do this.
o. The Customer may choose to provide specific requirements about their ideas, visions and expectations of the Movie. It is your responsibility to make the Movie in line with these requirements. Alternatively, the Customer may give you freedom to make the Movie as you decide.
p. You must not circumvent these Terms by communicating with Customers or agreeing the provision of the Creator Services outside of the Website, whether for payment or not. To do so is a material breach of these Terms. If you have been asked by the Customer to do so, please report it to us by email to reports@yourmovie.co.uk as soon as possible.
6. Copyright and intellectual property rights
a. Creator
i. As explained in these Terms, the Customer will provide you with Customer Content so that you can make the Movie. As part of this process, it is expected that you will use music, audio, video or photos that is not Customer Content but sourced from third party source(s).
ii. In the provision of the Creator Services, you must only use content in the Movie which is free from copyright or for which you have been granted a licence to use the copyrighted content for commercial purposes by the copyright owner. Compliance with copyright and intellectual property laws and regulations is solely your responsibility.
iii. You hereby undertake to indemnify Your Movie and to keep it at all times fully indemnified from and against all losses arising as a result of any action or claim that the Movie and/or the Creator Services constitutes an infringement of any intellectual property rights belonging to a third party.
iv. You understand you have no intellectual property rights over the Movie and nothing in these Terms nor nothing arising from the relationship with the Customer transfers or is deemed to transfer any copyright or intellectual property rights from the Customer to you or to any third party.
b. Customer
i. As explained in these Terms, you will provide the Creator with Customer Content so that the Creator can make the Movie. As part of this process, it is expected that the Creator will use music, audio, video or photos that is not Customer Content but sourced from third party source(s).
ii. In the provision of the Creator Services, the Creator must only use content in the Movie which is free from copyright or for which they have been granted a licence to use the copyrighted content for commercial purposes by the copyright owner. Compliance with copyright and intellectual property laws and regulations is solely the Creator’s responsibility. You must not require or request that the Creator uses any content which would cause them to breach copyright or the intellectual property rights of any third party.
iii. However, by submitting the Customer Content, you warrant that you own the copyright to the Customer Content or have been granted a licence to use and share the Customer Content. You hereby undertake to indemnify the Creator and to keep them at all times fully indemnified from and against all losses arising as a result of any action or claim that the Customer Content constitutes an infringement of any intellectual property rights belonging to a third party.
iv. Further, you hereby undertake to indemnify Your Movie and to keep it at all times fully indemnified from and against all losses arising as a result of any action or claim that the Movie and/or the Creator Services constitutes an infringement of any Intellectual Property Rights belonging to a third party.
v. Nothing in these Terms nor nothing arising from the relationship with the Creator transfers or is deemed to transfer any copyright or intellectual property rights in the Customer Content from you to the Creator or to any third party.
vi. You understand that you are fully and solely legally responsibility for the consequences of sharing the Movie or publishing it on the internet.
7. Payments and fees of services
a. Payment of the Movie Fee is required in advance before the Creator Services can start.
b. Payments to Creators
i. Your Movie will collect the Movie Fee from the Customer on your behalf. After the Movie Fee is received, you will get a short notice with request to approve the order. If you decline the order the Movie Fee will be sent back to the Customer Balance. After the Movie was created by you, and provided the Customer has not opened a dispute about the Creator Services, Your Movie will charge you the Creator Fee and deduct this from the Movie Fee. The balance, being the Creator Revenue, will appear on the Creator Balance, and you may withdraw the funds anytime you wish to.
ii. If the Customer is satisfied with your Services and has not opened a dispute within 7 calendar days of receiving the Movie, it is assumed the Creator Services were completed successfully and the Creator Revenue will appear in the Creator Balance soon after.
c. Payments from Customers
i. Once you have confirmed your order of the Creator Service, you will need to pay the Final Fee advertised in the Services Package, which for the sake of clarity is a total of the Movie Fee and the Service Fee, as applicable.
ii. If you have purchased the Creator Services and by some reason cancelled it (or the Creator cancelled it), the Final Fee will be refunded to your Customer Balance and you may buy other Creator Services or withdraw the funds to your bank account.
d. If you want to withdraw funds from the Creator Balance or Customer Balance, as applicable, you may do that in one of three ways:
i. By providing the account number, sort code and full name (if to a British bank) or IBAN, SWIFT code and Full name (if to a bank outside of the UK); or
ii. By withdrawing to PayPal.
e. You cannot withdraw more money than is held in the Creator Balance or the Customer Balance.
f. You are solely responsible for the payment of any other fees, taxes, exchanging fees and your personal or business taxes, applicable in your operating country.
8. Successful/unsuccessful movie
a. When the Creator uploads the Movie to the Website (via AWS), you (as a Customer) should watch it to confirm you are satisfied with it. After that, you will be able to download the Movie to your device or upload it into Google Drive/AWS storage.
b. The Movie is considered successful if it has been made in accordance with:
i. these Terms;
ii. Customer’s specific requirements, if provided by the Customer.
c. If the Movie has not been made in accordance with at least one of the points above, the Movie may be considered unsuccessful if the Customer opens a dispute in line with clause 9 below.
9. Disputes
a. Following the provisions of clause 8 above, Customers that reasonably believe that the Movie should be considered unsuccessful have 7 calendar days after receiving the Movie to raise a dispute. Firstly, you should communicate with the Creator and express your dissatisfaction about the Movie. If the two of you cannot find a reasonable and satisfying decision, you may open a dispute through your Account or by emailing us at disputes@yourmovie.co.uk. The Your Movie team will do our best to assist you and look for the best ways to resolve the issue.
b. Please keep in mind that Creators use their own imagination, passion, and their own style to create Movies. Before you choose the Creator, take a careful look at the video examples on the Public Profile or discuss your interests and wishes for the Movie with the Creator. It is the Customer’s sole responsibility to choose the Creator carefully and to express the needs and expectations of the Movie clearly.
c. Your Movie will not look into the content transferred using AWS services integrated in Your Movie website, as all content transferred between a customer and a creator stay in AWS servers. In case of dispute or Your Movie (or AWS) suspects that any illegal and harmful content have been transferred using AWS services integrated in Your Movie website, we might download the suspicious content for the investigation. AWS Terms and Conditions, Notice and Take Down policy and other related documents apply.
10. Cancellations
a. Your Movie reserves the right to cancel any order if any fraudulent transactions or harmful behaviour has been suspected from Customer’s/Creator’s side.
b. If an order has been cancelled, no Creator Services will be delivered to the Customer and the Final Fee will be refunded to the Customer Balance. The Customer may then buy another Creator Services or may withdraw the funds.
c. Customers can cancel an order for Creator Services and receive a refund of the Final Fee with no questions asked until the Creator approves the order. After approval of the order by the Creator, Customers should not cancel the order without a valid reason.
d. If a Customer decides to cancel an order after the Creator approves it, the Your Movie team may approve the cancellation request, only if:
i. the Creator is late to complete the Creator Services and does not respond to the Customer and/or the Your Movie team via their Account within 48 hours;
ii. the Creator is no longer active on the Website, such as due to temporary or permanent suspension;
iii. the Creator is offensive, impolite, or uses poor language or behaviour, in which case clause 10(e) will also apply;
iv. the Creator does not provide the Movie within the agreed timescales;
v. the Creator is late delivering the Creator Services and has not agreed an extension of time for his Creator Service with the Customer and does not have explainable reasons for the delay.
e. As a consequence of clause 10(d) above, the Creator may receive a warning, or may be temporarily or permanently suspended from using the Your Movie Services, depending on how many times such behaviour is reported.
f. If you think that there is another important reason to cancel the order, please email us at disputes@yourmovie.co.uk.
11. Customer’s and Creator’s Guarantee
a. If you are the Customer, the Movie Fee is paid to and held by Your Movie. After you are satisfied with the Movie, we will pay the Creator the fees they are owed. This means that during the Creator Services, the Final Fee will be safe and be available to return to you in the event you are eligible for a refund.
b. If you are the Creator, the Creator Revenue will be added to your Creator Balance after the Creator Services have been completed and the Movie is declared by the Customer as successful.
12. Appropriate Use
a. In addition to the other requirements within these Terms, this clause includes specific rules that also apply to your use of the Your Movie Services.
b. While using the Your Movie Services you must not:
i. in the case of Creators, knowingly provide any fake, dishonest, inaccurate or misleading information, such as about your credentials, experience or availability;
ii. use the Your Movie Services if we have suspended or banned you from using it;
iii. promote or advertise any services, other than the Creator Service;
iv. send any marketing communications through the Website;
v. submit or contribute any information or commentary about another person except than leaving reviews about Creators you have received Creator Services from;
vi. enter into any other agreement for Creator Services with a Customer or Creator that was introduced to you via the Website; or
vii. knowingly introducing viruses, Trojans and other harmful material to the Website or to other users.
c. Failure to comply with these rules means that we reserve the right (with notice or without) to:
i. temporary or permanent suspension of your use of the Website and all or part of the Your Movie Services;
ii. temporary or permanent removal of your Account and/or Public Profile; or
iii. report you to law enforcement or any relevant institution.
13. Ending the relationship
a. You can end our relationship by closing your account, or by emailing us to request closure of your account to info@yourmovie.co.uk.
b. We may suspend and/or terminate your relationship with us if we suspect your behaviour is illegal or you might have breached of Terms, the Policies, or other documents mentioned in them, in which case your Account will be suspended immediately, your Public Profile will be temporarily hidden, and we will commence an investigation. Our decision arising from the investigation will be provided to you via your Account and/or by email.
c. We reserve the right to end your relationship with us even if you have active order. In this case we may terminate the order and refund the Customer the Final Fee in full.
d. Where we terminate your relationship with us, we will:
i. permanently delete all data you provide to us (including the Public Profile, Account information and everything else); and
ii. request in writing that you withdraw any funds in the Creator Balance or Customer Balance as soon as possible.
14. Disclaimers
a. Your Movie does not create, sell or buy Movies. Your Movie is not a party to any transaction between the Customer and the Creator. The Creators are third party suppliers to Your Movie and are not our employees, workers, agents or contractors. We also do not monitor the quality of Movies unless there is a dispute between Creator and Customer with regards to quality of a Movie and the Customer and/or Creator grants us access to the Movie to check its quality.
b. The Website is provided on an as-is and as-available basis. You agree that your use of the Website will be at your sole risk. To the fullest extent permitted by law, Your Movie disclaims all warranties, express or implied, in connection with the Website and the Your Movie Services and your use thereof, including, without limitation, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
c. Your Movie is not responsible for nor does it not monitor Movies or Public Profiles. Your Movie makes no representations, warranties or undertakings about the Creators that advertise on the Website, nor about the Creators’ credentials, qualifications, experience, including without limitation, their merchantability, quality or fitness for a particular purpose, or the trustworthiness of a Creator.
d. Your Movie makes no representations, warranties or undertakings that the Website, or the server(s) upon which it is hosted, will be free from defects, including, but not limited to viruses or other harmful elements. To the maximum extent permitted by law, Your Movie accepts no liability for any infection by computer virus, bug, tampering, unauthorised access, intervention, alteration or use, fraud, theft, technical failure, error, omission, interruption, deletion, defect, delay, or any event or occurrence beyond our control, which corrupts or affects the administration, security, fairness and the integrity or proper conduct of any aspect of the Website.
e. Your use of the Website is at your own risk, as are any Creator services you purchase on the Website. Your choice of the Creator is solely of your own volition.
f. You assume complete responsibility for, and for all risk of loss resulting from your downloading, or using of, or referring to, or relying on, the facilities, service(s) or information provided on the Website, or any other information obtained by you through your use of the Website. You agree that, to the maximum extent permitted by law, Your Movie will not be liable for damages arising out of your use or your inability to use the Website or the Your Movie Services, and you hereby waive any and all claims with respect thereto, whether based on contract, tort or other grounds.
15. Limitation of liability
a. To the fullest extent permitted by applicable law, neither Your Movie nor any of its officers, directors, employees, agents or other representatives will be liable for any loss or damage arising out of, or in connection with, your use of the Website, the Your Movie Services, or the Creator Services facilitated through the Website including, but not limited to, direct, indirect or consequential loss or damages, loss of data, loss of income, profit or opportunity, loss of, or damage to, property and claims of third parties, even if Your Movie has been advised of the possibility of such loss or damages, or if such loss or damages were reasonably foreseeable.
b. In no event shall Your Movie nor any of our officers, directors, employees, agents or other representatives be liable for any damages whatsoever resulting from the statements or conduct of any Creator or Customer, or the interruption, suspension or termination of the Website or the Your Movie Services, whether such interruption, suspension or termination was justified or not, negligent or intentional, inadvertent or advertent.
c. Without limitation to the foregoing, under no circumstances shall Your Movie nor any of its officers, directors, employees, agents or other representatives be held liable for any delay or failure in performance of the Website or the Creation Services advertised on the Website, resulting directly or indirectly from acts of nature, forces or causes beyond their reasonable control, including, without limitation, internet failure, computer equipment failures, telecommunication failures, other equipment failures, electrical power failures, strikes, lay-way disputes, riots, interactions, civil disturbances, shortages of labour or materials, fires, floats, storms, explosions, acts of god, war, epidemic, pandemic, governmental actions, orders of domestic or foreign courts or tribunals or the non-performance of a third party.
d. For the avoidance of any doubt, Your Movie does not exclude liability for death or personal injury caused by its negligence or that of its employees or authorised representatives or for fraud, or anything that cannot be legally excluded.
16. Indemnification
You agree to defend, indemnify, and hold Your Movie harmless from and against any and all liabilities and expense whatsoever – including without limitation, claims, damages, judgments, awards, settlements, investigations, costs, legal fees, and disbursements – which Your Movie may incur or become obligated to pay, arising out of or resulting from the offering for sale, the sale, and/or use of the Website, the Your Movie Services or the Creator Services, excluding, however, any such expenses and liabilities which may result from a breach of these Terms or sole negligence or wilful misconduct by us. In consideration of and as part of your payment for the Your Movie Services and/or the Creator Services, you hereby release, waive, acquit, discharge, indemnify, defend, hold harmless and forever discharge Your Movie of and from all actions, causes of action, contracts, claims, suits, costs, demands and damages of whatever nature or kind in law or in an equity arising from the Website, the Your Movie Services and/or the Creator Services.
